Canadian entities (including trusts) will be required to certify their FATCA classification to their financial institutions. The classifications are complex and determine how much information these entities will be required to disclose to the financial institution.
In many cases the FATCA certification is made under penalty of perjury and, if incorrectly made, could result in unnecessary withholding or other penalties.
Identification of US citizens, residents, or entities is critical for not only FATCA compliance, but also for providing legal, tax, estate planning, and financial advice.
